These Terms & Conditions ("Terms") govern your use of shopclearskies.com and qr.shopclearskies.com (the "Site") and any purchase you make from Clear Skies LLC ("Clear Skies," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site or purchase our products.
1. Eligibility
You must be at least 21 years old to use this Site or purchase our products. By placing an order, you confirm that you are 21 or older and that you are legally able to enter into a binding agreement.
2. Our products
Our products are topical products made with hemp-derived CBD. They are for external use only and are not intended to be eaten, inhaled, or applied to broken skin.
Product images are for illustration. Packaging and labels may vary slightly from what is shown on the Site.
3. Not medical advice
Our products are not intended to diagnose, treat, cure, or prevent any disease. Nothing on the Site is medical advice. Consult your physician before use if you are pregnant, nursing, taking medication, or have a medical condition. Test on a small area of skin first and stop use if irritation occurs. Keep out of reach of children and pets.
4. Where we ship
Laws regarding hemp-derived CBD products vary by state and locality. Clear Skies decides where we ship, and we do not ship to states or localities where we believe our products may not be lawfully sold or delivered. If an order is placed for delivery to one of those locations, we will cancel it and issue a full refund. These Terms do not shift our own legal obligations to you.
5. Lab testing
Independent laboratory reports are available by batch number on our batch lookup page, using the batch number printed on the bottom of each jar. Each batch page identifies the material tested and the substances tested for. Lab reports reflect the results for the sample tested and are not a guarantee of any particular result from using the product.
6. Orders and pricing
All prices are listed in U.S. dollars. The order confirmation email you receive after checkout confirms that we have received your order; it does not mean we have accepted it. We accept your order when we ship it and send you a shipping confirmation. Until then, we may cancel an order, for example because of a pricing or description error, limited stock, or a shipping restriction. If we cancel an order after you have been charged, we will refund the full amount to your original payment method.
If we cannot ship your order within the time stated at checkout, or within 30 days if no time is stated, we will tell you and give you the option to cancel for a full refund.
7. Payment
We accept Visa, Mastercard, Discover, and American Express, along with other payment methods shown at checkout. Payment is due when you place your order. By submitting payment, you confirm that you are authorized to use the payment method provided. Applicable sales tax is calculated and shown at checkout.
8. Shipping
We currently ship within the United States only. Standard shipping is free on orders over $50. Available shipping methods, costs, and estimated delivery times are shown at checkout. Delivery times are estimates and are not guaranteed. Title and risk of loss pass to you when your order is delivered to the shipping address you provided.
Lost, stolen, or damaged packages. If your order hasn't arrived by the estimated delivery date, is marked delivered but you can't find it, or arrives damaged, email us at hello@shopclearskies.com with your order number. Please let us know within 14 days of the estimated delivery date if you can, since carriers limit how long a claim can be opened. We will look into it with the carrier and then send a replacement or issue a refund as appropriate. Reporting a problem later does not affect any rights you have under applicable law.
9. Returns and refunds
30-day money-back guarantee. If you're not happy with your purchase, contact us at hello@shopclearskies.com within 30 days of delivery with your order number. Opened and partly used jars qualify; empty jars do not. Each customer may receive one money-back guarantee refund. This limit does not apply to damaged, defective, or incorrect orders, which are always covered as described below.
Returns. We'll email return instructions. Return shipping is paid by you, and your refund is issued once the jar is delivered back to us.
Damaged, defective, or incorrect orders. Email us a photo with your order number. We cover all costs and will send a replacement or a full refund, usually without needing the product back. If we need to inspect it, we'll send a prepaid return label.
Refunds. Refunds cover the product price. Original shipping charges are not refunded, except for damaged, defective, or incorrect orders. Refunds are issued to your original payment method within 10 business days after we receive the returned product, or after we approve the refund when no return is required. Your card issuer may take a few more days to post it.
10. Intellectual property
All content on the Site, including text, images, logos, and designs, is owned by or licensed to Clear Skies LLC and may not be copied, reproduced, or used without our written permission.
11. Disclaimer of warranties
Except as expressly stated in these Terms, the Site and our products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. Some states do not allow certain warranties to be disclaimed, so some of these disclaimers may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Clear Skies LLC and its owners, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.
These limitations do not apply to liability for personal injury caused by our negligence, to liability for our gross negligence, fraud, or willful misconduct, or to any other liability that cannot be limited or excluded under applicable law. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived by contract.
13. Indemnification
You agree to indemnify and hold harmless Clear Skies LLC from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your misuse of our products, your violation of these Terms, or your violation of any law.
14. Privacy
Our collection and use of your personal information is described in our Privacy Policy.
15. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date above will change. The Terms in effect when you place an order apply to that order.
